This manual outlines how to request access to records held by Tersia King Learning Academy. All requests are handled by our Information Officer in accordance with the Act.

1. Background

The Promotion of Access to Information Act No. 2 of 2000 ("the Act") gives effect to the constitutional right of access to information held by the state and by private bodies, where that information is required for the exercise or protection of a right. In terms of Section 51 of the Act, all private bodies are required to compile an Information Manual.

5. Guide of the SA Human Rights Commission

The South African Human Rights Commission has compiled a guide on how to use the Act. Enquiries may be directed to:

6. Records held by Tersia King Learning Academy

The school holds records relating to the following categories:

  • Personnel records (employment contracts, performance records, training records)
  • Learner records (academic records, medical information, application forms)
  • Financial records (fee accounts, banking records, statutory filings)
  • Operational records (policies, procedures, internal correspondence)
  • Parent records provided in the course of enrolment
  • Statutory records maintained in terms of applicable legislation

Some records are publicly available without a formal request (such as those on this website). Other records require a formal request in terms of the Act.

7. How to request access to records

Step 1: Complete Form 2

Complete the prescribed Form 2 (available from the Information Regulator's website) with sufficient detail to identify the record and yourself as the requester.

Step 2: Submit the form

Submit the completed form to the Information Officer by:

  • Hand delivery to the school's physical address
  • Email to tkla@tkla.co.za
  • Prepaid registered post

Step 3: Pay the request fee

A request fee of R50.00 is payable upfront (not applicable to personal requesters seeking their own information). The school will advise you of any additional access fees before processing.

Step 4: Await a decision

The school will respond within 30 days of receiving your complete request, either granting or refusing access with reasons.

All fees must be deposited into the school's bank account. Banking details will be provided upon receipt of your request. Fees are subject to change in line with the Act.

9. Grounds for refusing access

The school may refuse access to records where disclosure would:

  • Unreasonably disclose personal information of a third party (Section 63)
  • Reveal trade secrets or cause harm to commercial interests (Section 64)
  • Breach a confidentiality agreement (Section 65)
  • Endanger the safety of an individual or property (Section 66)
  • Disclose information privileged in legal proceedings (Section 67)
  • Harm the school's own commercial activities (Section 68)

The Information Officer's decision is final. Requesters who are dissatisfied may apply to a court of competent jurisdiction within 30 days of notification of the decision.

This manual is available on this website and for inspection at the school's premises during office hours. It will be updated annually. For the full manual including all prescribed forms, please contact the Information Officer.
